Custody / Visitation

Custody and visitation of minor children is one of the most emotionally difficult decisions to make in a divorce case. This can be and often is the center of much animosity, anger, and resentment between husband and wife or exes.

Florida requires one parent to be the primary custodian and the other will be a secondary custodian with some kind of visitation rights (often called "time sharing"). The plan for how children will spend their time between you and your spouse can be agreed upon ahead of time by you and your spouse through a marital agreement or some other plan. If you and your spouse cannot agree, then a court will take evidence and testimony and make a ruling based upon what is in the best interest of the child.

Whether entered into by agreement or court order, a custody plan can usually be modified. This can mean a change of who has primary custody, time sharing, or types of supervision allowed. The best interest of the child should always be at the forefront of any agreement and this is the primary concern for any judge to consider when awarding and modifying custody arrangements
