Divorce is one of the most difficult things that a person can go through. By hiring an attorney, you can help the process go as smoothly as possible. You can also help to ensure that the things that are most important to you—your children, your home, your assets—are protected.

There is often a tremendous amount of posturing and game-playing between couples in the months, or years, prior to divorce. People can be afraid and reluctant to hire an attorney for fear that they will make the process more difficult or contentious.

This is far from the truth: a divorce attorney can step in to your shoes, guide you, and help you to confidently make difficult decisions. We find that this takes tremendous pressure off of the shoulders of the person and allows them to begin to complete the healing process.

Florida is a no fault state. This means that there is no burden to explain to a judge why you want a divorce or a need to defend yourself if it is your spouse asking for the divorce. There are two reasons Florida allows for a divorce:

  1. The marriage is irretrievably broken
  2. There is some sign of mental incapacity of one spouse

The most common reason cited is that a marriage is irretrievably broken. This means that you and your spouse have tried to work things out, but for whatever reason there is no agreement or ability to live civilly with one another anymore. Before a final judgment of dissolution is entered, a judge may want to hear from you and your spouse about what steps you have taken to work out your differences.
